Just a little more information on this topic from the legal experts at American Chemistry Council.... Rachel E. Ted" Subject RE: [DCHAS-L] DHS/MSDS - Question from Member MSDSs are part of the OSHA Hazard Communication Standard, so OSHA is the agency that writes rules for them, not DHS. I looked at OSHA's website and they did publish an advance notice of proposed rulemaking (ANPRM) in the September 12 Federal Register about their plans to revise the Hazcom standard to follow the Global Harmonized System. Here's the link: http://www.osha.gov/pls/oshaweb/owadisp.show_document?p_table=FEDERAL_RE GISTER&p_id=18890 But I skimmed over this notice and didn't see any discussion of homeland security issues. I think somebody got their communications wires crossed somewhere in the round trip between here and Brazil. DHS's new facility security rules are due out April 4. DHS will likely publish an ANPRM around Thanksgiving, plus or minus 10 days. But I wouldn't expect that rulemaking to contain anything touching on MSDSs. -- Jamie James W. Ted; Conrad , James W. Jr Subject: RE: [DCHAS-L] DHS/MSDS - Question from Member Hi Dave and Dan, There are no new DHS regs yet on MSDSs, as far as I am aware. I know there has been some discussion re: same in the midst of the work on the chemical facility security regs that are being drafted (proposal expected Nov. 4th), but I am not aware of anything final. I'm cc:ing my colleagues Ted Cromwell and Jamie Conrad, however, in case they have heard something I haven't. Cheers, Amy ~~~ ~~~ ~~~ ~~~ ~~~ Amy L.
